Pamela Bracher is a trial attorney and the deputy general counsel at the ATA. Her background and experience working in the trucking industry make her uniquely qualified for her role in advocating for policy development and legal changes on behalf of the trucking industry.
In this episode, Bracher discusses the differences between asset-based carriers and truck brokers and the liabilities that can be assigned to each in the case of an accident. Shippers need to understand the differences and the risks associated with each.
Bracher also describes the Carmack Amendment, a law that limits a trucker’s liability when there is loss or damage to a shipment. She identifies ways that companies can mitigate their risk and the time limits for filing a claim. The use of technology, including telematics—technology that transmits, receives, and stores vehicle data—and how this information is used in the case of a trucking accident. This includes the use of outward and inward-facing dash cams.
Her advice for upcomers in the trucking industry is to always learn new things, consider lateral moves in your career, and continuously build your network.
